3. CONTENT DESCRIPTION

This is the technical-legal and political-legal study of Labour Law, its normative development, as well as the institution of the employment contract, origin, vicissitudes, essential elements and suspension-termination of the contract.

In addition, the Statute of Autonomous Work is studied.

 

4. COURSE DESCRIPTION AND TEACHING METHODOLOGY

The course will comprise a theoretical part and a practical part. The theoretical part will be addressed following the subject's program and in accordance with the recommended basic bibliography.

The exhibition classes are intended for students to acquire the legal terminology and knowledge necessary for understanding and mastering the essential institutions of the subject. Students must have previously prepared the classes with the recommended basic bibliography.

The practical class involves the study of practical assumptions ideally elaborated or extracted from social practice to which an attempt is made to provide a solution in accordance with the legal system. For its resolution, students must handle both the jurisprudence, extracted from the main databases, and the recommended bibliography.

Likewise, through the presentation and debate of works, students will be able to learn to express themselves correctly, orally and in writing, and to reason about the topics debated, developing their critical capacity.

Furthermore, the course materials will be made available to students through the virtual subject that can be accessed through the virtual platform of the University of Jaén. Likewise, students will be able to contact the teaching staff and resolve their doubts through the virtual platform and through face-to-face tutoring in the corresponding offices.

Students with special educational needs should contact the Student Attention Service (Servicio de Atención y Ayudas al Estudiante) in order to receive the appropriate academic support

5. ASSESSMENT METHODOLOGY

The evaluation system is structured on 3 aspects:

  • Class attendance and/or participation in face-to-face and virtual activities that will be positively valued and controlled.
  • The assimilation and understanding of labor-legal institutions through theoretical examination.
  • The completion of work and case studies to be delivered to the teacher. In some cases, they will be exposed by the students and will be corrected in class before all the attendees.

Each of these evaluation tests will have the specific weight that appears in the evaluation system. However, the marks obtained in attendance and in the practical will only be taken into account in the final evaluation if the student has passed the theoretical exam. Therefore, to be able to add the mark of the practices and attendance to that of the theoretical exam and thus obtain the final grade, it will be necessary for the student to have obtained at least 4 points on the exam.

The master classes will be taught in person. If the anticipated capacity is greater than the authorized one, for the assistance it will be rotated in groups (50% depending on the assigned classroom capacity). The rest of the group will attend by videoconference.

Purpose: In accordance with the Universities Law and other national and regional regulations in force, carrying out exams and assessment tests corresponding to the courses students are registered in. In order to avoid frauds while sitting the exam, the exam will be answered using a videoconference system, being able the academic staff of the University of Jaén to compare and contrast the image of the person who is answering the exam with the student's photographic files. Likewise, in order to provide the exam with evidential content for revisions or claims, in accordance with current regulation frameworks, the exam will be recorded and stored.

Legitimacy: compliance with legal obligations (Universities Law) and other national and regional regulations currently in force.

Addressees: service providers who are the owners of the platforms where the exams are carried out and with whom the University of Jaén has signed the corresponding data access contracts.

Storage periods: those established in current in force regulations. In the specific case of exam videoconference recordings, not before the examination records and transcripts are closed or the exam can still be reviewed or challenged.

Rights: you can exercise your right of access, amendment, cancellation, opposition, suppression, limitation and portability by sending a letter to the postal or electronic address indicated above. In the event that you consider that your rights have been violated, you may submit a complaint to the Andalusian Council for Transparency and Data Protection www.ctpdandalucia.es
