3. CONTENT DESCRIPTION

Chapter 1: Law and society: Patrimonial Law as part of civil law

Chapter 2: Person's law. natural persons and personality. Civil and legal capacity. Representation: power of attorney.

Chapter 3: Incapacitation. Special reference to the Convention of the rights of the people with disabilities of 2006.

Chapter 4: The obligation: Elements of the obligatory relation. Types of obligation: special reference to obligations with several presons involved. Performance of obligations: payment and special ways of performance.

Chapter 5: Non-performance of obligations: Types of non -performance: total breach and defective performance. Negligence and act of God and force majeure.  Action for performance. Liability of the debtor.

-Chapter 6: Ways of extinguishing obligations other than payment.

-Chapter 7: The contract: General theory of the contract. Elements and types of contract. Formation of contracts. Contracts with general conditions of sale.

-Chapter 8: Law of things: Types of real rights. Acquisition of real rights. Property Registry.

-Chapter 9: Family Law: Introduction. Economical system of marriages and types. Special reference to the community property system.

-Chapter 10:  Notions of Successsion Law: The heir. Testamentary or voluntary succession: the will. The legitime. Legal succession or succession ab intestato.

4. COURSE DESCRIPTION AND TEACHING METHODOLOGY

The Methodology and activities of the subject matter are oriented to the achievement of the learning outcomes associated with the competences required for the subject: R8, R9, R16 and R20. The activities will take place in expository classes  in large group (three hours per week) and two groups of practices (1 hour weekly). Through them, the student: a) will be able to apply the acquired knowledge to real-life situations (R16) b) will acquire the capacity for analysis and resolution of problems proposed and not resolved in the classroom (R20) c) will acquire the capacity for analysis and synthesis (R8) d) will dominate the oral and written communication in language native (R9).

The subject shall comprise a theoretical part and a practical one. The theoretical part will be explained following the syllabus of the subject and according to the recommended basic bibliography. The expository classes are intended for the student to acquire the legal terminology and the knowledge necessary for understanding and mastery of the essential juridical institutions of the subject. The students must have prepared previously the classes with the recommended basic literature. The Practical class involves the study of some practical cases ideally prepared or extracted from the social practice in order to provide them with a solution in accordance with the legal system. For its resolution, the students must handle both the jurisprudence, extracted from the main database, and the recommended bibliography.

Also, through the exhibition and discussion of works the students can learn to express themselves correctly, in oral and written form, and to reason on the debated issues, developing their ability to critical thinking. On the other hand, the course materials will be available to students through the virtual subject to which students may access through the Virtual platform and through face-to-face tutorirals in the bureau of the Professor.

5. ASSESSMENT METHODOLOGY

The assessment system aims to verify that students have acquired learning outcomes envisaged in the subject. The performance academic will be evaluated through a test end that includes: a test theoretical written with a series of questions of brief development (R16), and on the other hand the resolution of one or several practical cases (R8, R9 and R20). Also along the course will be assessed complementary elements that serve as a basis and support to the former. In this assessment, students must demonstrate that: a) will be able to apply the acquired knowledge to real-life situations (R16) b) will acquire the capacity for analysis and resolution of problems proposed and not resolved in the classroom (R20) c) will acquire capacity for analysis and synthesis (R8) d) will dominate the oral and written communication in language native (R9) the theoretical concepts of matter will be valued in the final examination in a percentage of 60% theory and 20% practice.

To take into account the note corresponding to the attendance and participation (10%, 1 point), page 6 of 7 preparation of work, cases and exercises (10%, 1 point) and the qualification of the practical examination (20%, 2 points), a mark of 3 points out of 6 in the theoretical exam will be essential. The same system will be maintained elsewhere for the rest of the academic year. The students who only present the theoretical and practical examination will be reduced its assessment to 80% of the note.
